PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY.

All products offered by TEKNIK HANDHOLDS, INC. are sold and provided to you subject to the following terms and conditions. The terms and conditions set forth below are principal components of the agreement between TEKNIK HANDHOLDS, INC.  and you (the “Buyer”).  Buyer understands and agrees that TEKNIK HANDHOLDS, INC. fulfills Buyer’s order(s) subject to the following terms and conditions and that TEKNIK HANDHOLDS, INC.  would not provide any product(s) to Buyer without Buyer’s agreement to these terms.  By using this site, ordering and accepting any product(s) from TEKNIK HANDHOLDS, INC. (the “Product”), Buyer irrevocably acknowledges Buyer’s agreement to the terms and conditions listed below.

Climbing Is Inherently Dangerous Safety is Your Responsibility - climbing anywhere on anything, even when done properly, can result in injury or death. You are solely responsible for obtaining proper training and/or instruction before using any of our Products. Use all TEKINK HANDHOLDS, INC. Products at your own risk. TEKNIK HANDHOLDS, INC. explicitly disclaims any and all responsibility and liability for any death, injury, loss, and/or damage to any person or property that may occur, that arises out of, or is in any way related to the use, or misuse, of TEKNIK HANDHOLDS, INC. Products. By your purchase and use of TEKNIK HANDHOLDS, INC. Products you agree that you are solely responsible for your safety and you assume all risks and accept full and complete responsibility for all damages of any kind, including any death, injury, loss, and/or damage to any person or property, that arise out of, or are in any way related to use, or misuse, of TEKNIK HANDHOLDS, INC. Products.

Buyer is solely responsible for determining whether the Products are suitable for Buyer’s use and site, and for the conditions onsite where the Products will be used; Buyer and/or Buyer’s representatives and/or agents are solely responsible for knowing and performing the proper installation and use of the Products, and for insuring that all installation and use of the Products is performed properly; Buyer and/or Buyer’s representatives and/or agents shall have final approval and assume all responsibility for all such installation and use.TEKNIK HANDHOLDS, INC. hereby explicitly disclaims all responsibility for any claims, damages, or loss related to or arising from such installation and/or use.

Limited Warranty

Unless otherwise stated in writing,TEKNIK HANDHOLDS, INC. products are covered by a limited three-year warranty against manufacturer’s defects to the original Buyer. This limited warranty covers defects in materials and workmanship in the Products.  Color fade, loss of texture, wear and marking on the Products over time is normal and is excluded from this limited warranty. Modifying any Product and/or damage to any Products that arises from or is related to: normal use and wear, abuse, or accidents; modification; installation or use; improper cleaning; failure to follow any relevant instructions; and/or the like is not covered by this limited warranty and completely voids this limited warranty.

Other than as described above, TEKNIK HANDHOLDS, INC. makes no other representations or warranties, either expressed or implied, including without limitation any warranty of suitability for a particular purpose, or any warranty as to the design, condition or quality of materials and/or workmanship of any Products to the Buyer or to any other person whatsoever. TEKNIK HANDHOLDS, INC. expressly disclaims all responsibility for any indirect, consequential, incidental, punitive, or special damages, whether based on breach of contract, breach of warranty, tort (including negligence), and Product liability or otherwise, even if TEKNIK HANDHOLDS, INC. or it’s representatives have been advised of a possibility of such damages. Buyer agrees that it’s full remedy against TEKNIK HANDHOLDS, INC. for any liability, claims, or damages, shall be limited to the purchase price of the product and hereby irrevocably waives all claims for any other damages that Buyer may have. 

Warranty Claims

In the event Buyer wishes to return any Products that Buyer believes to be covered by TEKNIK HANDHOLDS, INC. limited warranty, Buyer shall return at Buyers expense the Product with a description of the issue and how it occurred. If TEKNIK HANDHOLDS, INC. determines that there is a warranty issue, TEKNIK HANDHOLDS, INC. may either replace the Products or refund or credit the Buyer’s account at TEKNIK HANDHOLDS, INC. sole discretion.

Typographical Errors In the event that a Product is mistakenly listed at an incorrect price, TEKNIK HANDHOLDS, INC. reserves the right to refuse or cancel any orders placed for product listed at the incorrect price, whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, TEKNIK HANDHOLDS, INC. shall issue a credit to Buyer.
